These Terms & Conditions govern your use of MarkitMedia.com and services provided by Markit Media. By using this website, requesting a quote, approving a project, or purchasing services from Markit Media, you agree to these terms.
1. Services
Markit Media provides professional printing, website development, search engine optimization (SEO), digital marketing, design, and related business marketing services.
The specific scope, cost, timeline, and deliverables for a project may be provided through a quote, proposal, invoice, email, or other written communication. Project-specific terms take precedence if they differ from these general Terms & Conditions.
2. Quotes and Pricing
Quotes are based on the information and specifications provided at the time of the request. Changes to quantities, materials, dimensions, design requirements, website functionality, project scope, shipping, deadlines, or other specifications may change the final cost.
Quotes may have an expiration date and are subject to availability of materials, services, and production capacity.
3. Payments
Payment terms may vary by project and will be communicated before or during the ordering process.
Deposits or advance payments may be required before design, printing, website development, or other work begins. Unless otherwise agreed in writing, final payment may be required before completed products are delivered, websites are launched, or final project files are released.
4. Printing Orders
Customers are responsible for reviewing and approving all proofs, quantities, dimensions, colors, spelling, contact information, dates, and other project details before production.
Once a printing order enters production, changes or cancellations may not be possible.
Colors displayed on computer screens and mobile devices can differ from printed colors. Minor variations in color, cutting, folding, placement, materials, and finishing may occur during commercial printing and are not necessarily considered defects.
5. Proof Approval
Approval of a proof authorizes Markit Media to proceed with production.
After approval, the customer assumes responsibility for errors that appeared on the approved proof, including spelling, grammar, dates, phone numbers, addresses, dimensions, design elements, and other content.
Markit Media may identify apparent errors as a courtesy but is not responsible for proofreading customer-approved materials unless proofreading is specifically included as part of the project.
6. Customer-Supplied Content and Materials
Customers are responsible for ensuring they have the legal right to use all photographs, logos, trademarks, graphics, text, videos, fonts, data, and other materials supplied to Markit Media.
By providing materials for a project, the customer represents that their use does not violate another person’s or organization’s copyright, trademark, privacy, publicity, or other rights.
Markit Media reserves the right to decline work that appears unlawful, fraudulent, deceptive, infringing, or otherwise inappropriate.
7. Website Development
Website projects may involve third-party products and services, including WordPress, themes, plugins, hosting companies, domain registrars, email providers, analytics platforms, search engines, and other technology providers.
Unless specifically included in an agreement, Markit Media does not control and is not responsible for changes, outages, security incidents, pricing changes, discontinued products, compatibility issues, or policy changes involving third-party services.
Customers are responsible for maintaining appropriate domain registrations, hosting accounts, subscriptions, licenses, and other ongoing services required for their websites.
8. SEO and Search Visibility
Markit Media uses professional practices intended to improve website quality, search visibility, local visibility, and the ability of search engines and AI-powered platforms to understand a business and its services.
However, no specific ranking, traffic level, lead volume, placement, or business result is guaranteed.
Google, Bing, ChatGPT, Gemini, Copilot, social platforms, directories, and other search or AI services control their own algorithms, indexes, recommendations, and results. These systems may change at any time without notice.
9. Digital Marketing and Third-Party Platforms
Marketing services may involve platforms such as Google, Meta, Microsoft, social networks, advertising platforms, directories, analytics services, and other third parties.
Markit Media cannot guarantee continued access to or performance from third-party platforms and is not responsible for account suspensions, algorithm changes, platform outages, policy changes, advertising disapprovals, or other actions controlled by those companies.
10. Project Timelines
Estimated completion dates are provided in good faith but may be affected by customer approvals, revisions, material availability, production schedules, third-party providers, shipping carriers, technical issues, or circumstances outside Markit Media’s reasonable control.
Customers are responsible for providing requested information, materials, approvals, and feedback in a timely manner.
11. Shipping and Delivery
When physical products are shipped or delivered through third-party carriers, delivery dates are estimates unless otherwise expressly guaranteed.
Markit Media is not responsible for delays caused by carriers, weather, incorrect delivery information, transportation disruptions, or other circumstances outside its reasonable control.
Customers should promptly report damaged or missing shipments so available remedies can be investigated.
12. Cancellations & Refunds
Because many Markit Media services and printed products are customized, cancellation and refund eligibility depends on the stage of the project.
Work already performed, design time already incurred, materials already ordered, and printing already placed into production may be non-refundable.
Any project-specific cancellation or refund terms provided in a quote, proposal, invoice, or agreement will control for that project.
13. Intellectual Property
Customers retain ownership of materials they provide to Markit Media.
Unless otherwise agreed in writing, Markit Media retains ownership of its pre-existing processes, methods, templates, systems, concepts, and other intellectual property.
Rights to completed custom design or website work may be transferred to the customer after all amounts due for the project have been paid, subject to any applicable third-party licenses.
14. Portfolio Use
Unless confidentiality has been agreed to in writing, Markit Media may display completed public-facing work as examples of its services, including in portfolios, websites, social media, proposals, and marketing materials.
Confidential information will not knowingly be published as portfolio material.
15. Website Information
Markit Media makes reasonable efforts to keep information on MarkitMedia.com accurate and current. However, website content may contain errors or become outdated.
Information on this website is provided for general informational purposes and should not be interpreted as legal, financial, tax, or other professional advice outside the services Markit Media specifically provides.
16. Limitation of Liability
To the extent permitted by applicable law, Markit Media will not be liable for indirect, incidental, special, consequential, or lost-profit damages resulting from use of this website or services.
For claims directly arising from a particular paid project, Markit Media’s liability will not exceed the amount paid to Markit Media for the portion of the service giving rise to the claim, to the extent permitted by law.
Nothing in these Terms & Conditions limits rights or remedies that cannot legally be limited or waived.
